1. Introduction
This Intellectual Property Policy (“Policy”) describes the ownership and permitted use of intellectual property rights in and in connection with the website at https://orbiano.com (“Website”), operated by PULSECORE TECH LTD (“Company”). It applies to all users of the Website.
2. Company Intellectual Property
2.1 Ownership
All intellectual property rights in the Website and its content — including text, graphics, logos, icons, images, software, source code, database compilations, and page layouts — are owned by or validly licensed to the Company. These rights are protected under:
- the Copyright, Designs and Patents Act 1988 (“CDPA 1988”);
- UK database rights arising under the Copyright and Rights in Databases Regulations 1997;
- registered and unregistered trade mark rights under the Trade Marks Act 1994;
- any other applicable intellectual property law in force in the United Kingdom.
2.2 Trade Marks
The Company’s name, logo, and brand identifiers displayed on the Website are proprietary to the Company. They may not be reproduced or used without prior written consent. Nothing on the Website grants any licence to use the Company’s trade marks.
2.3 Limited Licence to Users
Subject to compliance with the Terms and Conditions, you are granted a limited, personal, non-exclusive, non-sublicensable, non-transferable, and revocable licence to access and use the Website and its content for personal, non-commercial use only. This licence does not permit you to:
- copy, reproduce, or distribute Website content beyond what is strictly incidental to personal viewing;
- create derivative works based on Website content;
- use Website content for any commercial purpose without prior written authorisation;
- reverse engineer, decompile, or attempt to extract source code or data structures from the Website.
3. Third-Party Intellectual Property in Digital Products
Digital Products sold through the Website — including gaming codes, activation keys, and gift card codes — are intellectual property of their respective issuing brands, publishers, and developers (“Third-Party Rights Holders”). The Company operates as a retail reseller and holds no intellectual property rights in the underlying digital content.
Third-party brand names, game titles, logos, and trade marks referenced on the Website are used for descriptive and identification purposes only, in reliance on the nominative use defence under section 11(2)(b) of the Trade Marks Act 1994. Such use does not imply affiliation, sponsorship, or endorsement by the relevant Third-Party Rights Holders.
Upon redemption of any Digital Product, the end-user licence agreement of the issuing brand or publisher applies. The Company is not a party to that agreement and does not assume responsibility for its terms.
4. Restrictions on Use
Without the prior written consent of the relevant rights holder, you must not:
- reproduce, distribute, or frame any Website content;
- scrape or extract Website data by automated means;
- remove, alter, or obscure any copyright, trade mark, or proprietary notice on the Website;
- use any Website content in connection with any product or service not authorised by the Company.
5. Intellectual Property Infringement Reporting
If you believe content on the Website infringes your intellectual property rights, please send written notice to [email protected] with the subject line “IP Infringement Notice”, including:
- your full name and contact details, and confirmation of your authority if acting as agent;
- identification of the intellectual property right asserted, including registration numbers where applicable;
- identification of the allegedly infringing material, with sufficient detail to locate it on the Website;
- a statement that you hold a good-faith belief that the use is not authorised by the rights holder, their agent, or applicable law;
- a statement that the information provided is accurate.
The Company will acknowledge receipt within 5 business days and will investigate and respond within 14 business days. Where infringement is confirmed, appropriate remedial action will be taken.
6. Amendments
This Policy may be updated at any time. Changes take effect upon publication. Continued use of the Website constitutes acceptance.
